1. Agreement to these terms
By downloading, accessing, or using the Butter Agent mobile application (the "App") or our public website (the "Site"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App or Site.
If you use the App on an Apple device, Apple Inc. ("Apple") is not a party to these Terms except as described in Section 10 (Apple App Store).
2. The service
Butter Agent helps users create, plan, and manage trip-related information, including itineraries, expenses, and group collaboration features, subject to the App's current functionality.
We may update, modify, or discontinue features over time. We do not guarantee uninterrupted or error-free operation.
3. Eligibility
You must be able to form a binding contract where you live. The App is not intended for children under 13. If you are between 13 and the age of majority in your jurisdiction, you may use the App only with a parent or guardian's consent where required by law.
4. Accounts and security
Certain features require an account. You agree to provide accurate information, keep your credentials confidential, and notify us promptly of unauthorized use.
You are responsible for activity under your account, except where our systems are compromised through no fault of yours.
5. User content and license
You may submit content to the App (such as text, trip details, and other information you choose to enter).
- Your content: You retain ownership of your content.
- License to us: You grant us a worldwide, non-exclusive license to host, store, reproduce, process, display, and distribute your content solely to operate, secure, and improve the App and provide features you request (including sharing with trip members you authorize).
- Responsibility: You are responsible for your content and represent you have the rights needed to grant the license above.
6. Acceptable use
You agree not to violate any law or third-party rights; harass, abuse, or harm others; attempt to disrupt, overload, or reverse engineer the App except where permitted by law; use the App to transmit malware or unauthorized automated access; or misrepresent your identity or affiliation.
We may suspend or terminate access if we reasonably believe you violated these Terms or pose risk to users or the service.
7. Third-party services and links
The App relies on third-party services (including authentication and cloud infrastructure). Your use may be subject to third-party terms (for example Google or Apple account terms). We are not responsible for third-party services.
8. Fees
The App may be free to download. We may introduce paid features or subscriptions in the future. We will present pricing and obtain your consent before charging you, as required by applicable app store rules.
As of the Last updated date above, the App does not integrate third-party advertising SDKs; if we introduce advertising or materially new tracking, we will update our Privacy Policy and these Terms as needed.
9. Intellectual property
The App, Site, branding, and related materials are owned by Peera Kerdkokaew or licensors and are protected by intellectual property laws. Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, or create derivative works from the App or Site.
10. Apple App Store (iOS users)
If you downloaded the App from the Apple App Store, you acknowledge that:
- These Terms are between you and Peera Kerdkokaew, not Apple.
- Apple has no obligation to provide support for the App.
- Apple is not responsible for the App or its content.
- Apple is a third-party beneficiary of these Terms solely to the extent required to enforce these Terms related to the App Store terms.
- In the event of conflict between these Terms and the App Store Terms of Service, the App Store Terms of Service govern solely to the extent of such conflict.
11. Disclaimers
THE APP AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Butter Agent is not a travel agency, financial advisor, insurer, or legal advisor. Trip, expense, and settlement information is for informational and organizational purposes only. You are responsible for verifying important travel, financial, and legal decisions.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEERA KERDKOKAEW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR SITE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP/SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM (IF ANY), OR (B) USD $50.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted.
13. Indemnity
You will indemnify and hold harmless Peera Kerdkokaew from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the App, or your violation of these Terms, to the extent permitted by law.
14. Governing law and disputes
These Terms are governed by the laws of Thailand, without regard to conflict-of-law principles, except where mandatory consumer protections in your country require otherwise.
Courts in Thailand shall have exclusive jurisdiction for disputes arising from these Terms, subject to mandatory local protections where applicable.
15. Changes
We may modify these Terms. We will post updated Terms with a new "Last updated" date. Continued use after changes become effective constitutes acceptance, except where applicable law requires additional notice or consent.
16. Termination
You may stop using the App at any time. We may suspend or terminate access if we reasonably believe it is necessary for legal, security, or operational reasons.
17. Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
